These Terms & Conditions (“Terms”) govern the access and use of villestate.com and the Villestate mobile application available on Android and iOS (collectively referred to as the “Website”, “Application”, or “Platform”), owned and operated by Websequent Tech Private Limited (“Company”, “we”, “our”, “us”). By accessing, registering on, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Definitions

  • User: Any person who accesses or uses the Platform.
  • Buyer: A User searching for or inquiring about properties.
  • Seller: An individual or entity listing a property for sale or rent.
  • Broker / Agent: A real estate intermediary listing or promoting properties on behalf of sellers.
  • Property Listing: Any property information posted on the Platform.
  • Transaction: Any paid service, subscription, listing fee, or booking facilitated through the Platform.

3. Eligibility

  • Users must be at least 18 years of age.
  • Users must provide accurate, complete, and current information during registration.
  • The Company reserves the right to suspend or terminate accounts that provide false or misleading information.

4. Nature of Platform

  • The Platform is a technology-based real estate marketplace.
  • The Company does not own, sell, rent, or broker properties unless explicitly stated.
  • The Company is not a party to any agreement between buyers, sellers, or brokers.
  • Property transactions are conducted solely at the discretion and responsibility of the users.

5. User Accounts & Responsibilities

  • Users are responsible for maintaining the confidentiality of their login credentials.
  • Users shall not share their account or impersonate another person.
  • Users agree to use the Platform only for lawful purposes.

6. Terms for Buyers

  • Buyers may browse, search, and inquire about listed properties.
  • Buyers are responsible for independently verifying property details, ownership, approvals, and legal documentation.
  • The Company does not guarantee property availability, pricing, or suitability.
  • Any payments made by buyers are for Platform services only, unless explicitly stated otherwise.

7. Terms for Sellers (Individual Property Owners)

  • Sellers must have lawful authority to list the property.
  • All property information provided must be accurate and up to date.
  • The Company reserves the right to remove or modify listings that violate these Terms.
  • Sellers are solely responsible for compliance with applicable real estate laws and regulations.

8. Terms for Brokers / Agents

  • Brokers must be legally authorized to operate as real estate agents.
  • Brokers are responsible for the accuracy of listings posted on behalf of sellers.
  • The Company may request verification documents at any time.
  • Misrepresentation or fraudulent activity may result in account termination and legal action.

9. Payments & Fees

  • Certain services on the Platform may require payment.
  • All fees are disclosed prior to payment.
  • Payments are processed through secure third-party payment gateways.
  • The Company does not store card or banking information.
  • All payments, cancellations, and refunds are governed by the Company’s Cancellation, Return & Refund Policy, available on the Website and Application.

10. User-Generated Content, Media & Listings

  • Users, including buyers, sellers, and brokers/agents, may upload content such as property details, descriptions, images, videos, documents, and other media.
  • Users retain ownership of the content they submit; however, by uploading content, they grant the Company a non-exclusive, royalty-free, worldwide license to use, host, display, modify, reproduce, and promote such content on the Platform.
  • Users are solely responsible for the accuracy, legality, authenticity, and appropriateness of the content they upload.
  • The Company does not verify, endorse, or guarantee user-uploaded content and shall not be held responsible for any incorrect, misleading, offensive, hateful, defamatory, or unlawful content uploaded by users.
  • If any content is reported as violating applicable laws or these Terms, the Company reserves the right to remove or disable access without prior notice.
  • Users agree to indemnify the Company against any claims, penalties, or losses arising from user-uploaded content or media.

11. Prohibited Activities

Users shall not: Post false, misleading, or illegal property information; Violate any applicable laws or regulations; Upload malicious software or harmful content; Attempt unauthorized access to the Platform; Use the Platform for fraudulent or unlawful purposes.

12. Intellectual Property

  • All content, logos, software, and design elements on the Platform are the property of the Company.
  • Users may not copy, reproduce, or distribute Platform content without written permission.

13. Limitation of Liability

  • The Company is not responsible for disputes between users.
  • The Company does not guarantee the accuracy of property listings.
  • The Company shall not be liable for any indirect, incidental, or consequential damages.

14. Indemnity

Users agree to indemnify and hold harmless the Company from any claims, losses, damages, or expenses arising from: Use of the Platform; Violation of these Terms; Misrepresentation of property details.

15. Termination

The Company may suspend or terminate user access without prior notice if these Terms are violated.

16. Force Majeure

The Company shall not be liable for failure or delay in performance due to events beyond its reasonable control, including natural disasters, government actions, internet outages, system failures, or acts of God.

17. Modification of Services

The Company reserves the right to modify, suspend, or discontinue any part of the Platform, including features and pricing, at any time without prior notice.

18. App Store & Third-Party Disclaimer

  • Apple Inc., Google LLC, and their respective app stores are not responsible for the Platform or its content.
  • App stores are not parties to any transaction conducted through the Platform.
  • Any disputes remain solely between users and the Company.

19. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts at Ahmedabad, Gujarat shall have exclusive jurisdiction.
